False charges & FIR quashing: what you need to know

21 FAQs
111A false FIR has been lodged against me, what should be the first step?

Maintain peace. Contact a good criminal lawyer immediately. Get the copy of the FIR and start collecting all the evidence of your innocence.

112What does it mean to quash the FIR?

This means filing a petition under Section 482 of CrPC in the High Court, Prayagraj and getting the FIR quashed so that the case does not proceed further.

113What should be the grounds for cancellation of FIR?

The main grounds are — (1) No crime should be created by reading the FIR, (2) The case should be completely civil in nature, (3) The FIR should be written with a spirit of revenge or maliciously, (4) The legal process is being misused.

114Where is the petition for cancellation of FIR filed?

It can be filed only in the High Court. For Uttar Pradesh it will be in Prayagraj (Allahabad).

115Does filing a petition stop the arrest?

Mere filing of petition does not stop the arrest. You have to take a separate order for stay on arrest from the court.

116How much time does it take to get the FIR cancelled?

It depends on the complexity of the case. This may take from a few months to a year or more.

117What will happen if the petition is rejected by the High Court?

You have the option to appeal to the Supreme Court.

118Can FIR be canceled even after charge sheet is filed?

Yes, even after the charge sheet is filed, if you have strong grounds you can still file a petition to quash the FIR and the entire subsequent proceedings.

119How will I know if an FIR has been lodged against me?

You can check online on the UP Police website, or contact the police station through your lawyer.

120What action can be taken against someone who files a false FIR?

Once you are acquitted or the FIR is cancelled, you can file proceedings under Section 182/211 of the IPC and a defamation suit against the person who filed the false complaint.

121What is the strongest basis for quashing FIR?

The most common grounds are that the crime mentioned in the FIR does not constitute a legal offense (e.g. a civil dispute has been criminalised), or the FIR has been filed purely out of vindictive intentions, or has been proven to be false in the preliminary investigation itself.

122Can the police file FIR again after the FIR is quashed?

If the High Court has quashed the FIR, then the police cannot file an FIR again on the same facts without new and concrete material. But if new evidence comes to light, a fresh FIR can be registered.

123What is the main basis for cancellation of FIR?

If an offense is not made out on reading of the FIR, the allegations are merely civil disputes, malice is apparent, or there is an abuse of the legal process, the petition may be strengthened.

124Can cancellation happen even after charge sheet is filed?

Yes, the entire proceeding including the charge sheet and cognizance order can be challenged if the record does not give rise to an offence.

125How does FIR end after settlement in marital dispute?

The parties make the agreement in writing. Then a petition for cancellation of proceedings is filed in the High Court. The court gives the order after seeing the voluntariness of the agreement.

126The accused has gone to the High Court to get my FIR cancelled, what should I do?

You will have to appoint a lawyer in the High Court who will represent you and oppose the petition for cancellation of FIR.

127How can I strengthen my case in the High Court?

You have to give your lawyer all the evidence and facts that prove that the FIR is true and the accused has actually committed the crime.

128Can I appear in the High Court in person?

You can appear, but the legal process is complex, so it is important to have a lawyer who can argue on your behalf.

129If the accused gets a stay on arrest, does it mean that he is innocent?

No, it just means that he will not be arrested until the investigation is completed. He will have to cooperate in the investigation.

130Will the police help me in the investigation?

Yes, when the case is in the High Court, the government lawyer places before the Court the investigation (case diary) conducted by the police, which supports your case.

131How should the victim protest against the cancellation of FIR?

The victim can file a counter-claim, placing his evidence, injuries, threats, financial loss and the role of the accused before the court.
